  • You agree that your Content will not violate any applicable law or regulation or the rights of any other person.

4. Fees

  • Some Services may be subject to Fees.
  • You are responsible for paying all Fees associated with your use of the Services.
  • Fees are non-refundable except as expressly provided in these Terms.

5. Intellectual Property Rights

  • Webfomix owns all Intellectual Property Rights in and to the Services.
  • You may not use any of the Intellectual Property Rights of Webfomix without our express written permission.

6. Termination

  • We may terminate your access to the Services at any time, with or without cause, and with or without notice.
  • You may terminate your Account at any time.

7. Disclaimer of Warranties

  • THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
  • WE DO NOT WARRANT THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE.

8. Limitation of Liability

  • WE WILL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, AND PUNITIVE DAMAGES.
  • YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISSATISFACTION WITH THE SERVICES IS TO DISCONTINUE YOUR USE OF THE SERVICES.

9. Indemnification

  • You agree to indemnify and hold harmless Webfomix, its officers, directors, employees, agents, and affiliates from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the Services or your violation of these Terms.
